my tenant won't leave nor pay the rent

i have a tenant, eversince she moved in she is been late with the rent, making a few payments each month. This month we got into a few arguements because i'm tired of her lies and i need my money, i have a mortgage to pay. She is getting personal, bussiness is bussiness and friendship is something else. To make the story short she is saying that she is going to take me to court because of the way i spoke to her and because i told her that i didn't want my husband to speak nasty to her. I already gave her a month's notice to leave, but what is she leaves and doesn't pay me the owed rent??? What should i do??? this is my first home, and nothing like this happened with my last tenant????

First: Stop and take a breath. Dont let this get to the point where you have lost control. Its good that you do not want your female tenant talking to your husband. That removes the "intimidation" card from the table.

You are going to have to talk to a lawyer. NOW. If your tenant tells you that she is going to take you to court then stop talking to her and get an attorney to do all the talking for you. The way that many of the landlord- tenant laws are writen even innocent questions and comments can be blown up into something that you will loose in court over.
