Hate to answer a question with a question but, was there any notice's, what kind of lease is currently standing(month to month or yearly?)Is her rent paid up and current?need info.

They can actually give you a THREE day perform or cure if she isnt on the lease and proceed from there. If you arent over occupancy limits, then you should just have her follow the typical application procedures to qualify her, and add her to the lease. If they will not, then you have a Fair Housing lawsuit.

As long as she is not on a lease either party can submit a 30 day notice of termination. However, if she has lived there longer than a year the apartment complex must give a 60 day notice.
Really it boils down to, you dont have to give a reason to move and the apartment complex does not have to give you one as long as your on a month to month tenancy.

Any complex can served you a 60-Day notice (or 30-Day if you been living there under a year) to vacate and don't have to give you a reason. It sucks but it's true.
